The following terms and conditions govern the direct sale of products by BALANCE BREW PTE LTD to customers in Singapore or persons (“User”) accepting delivery. By using this website and/or accepting delivery of products ordered from BALANCE BREW PTE LTD via this website, User agrees to be bound by and accepts these terms and conditions. THESE TERMS AND CONDITIONS SHALL APPLY TO ANY SALE DIRECTLY FROM BALANCE BREW PTE LTD TO USER. Products described on this website are only available to residents of Singapore when ordered through this website and Internet Service Provider (ISP) within Singapore AND for shipment to an address within Singapore. BALANCE BREW PTE LTD reserves the right to change these terms and conditions without prior written notice at any time, at its sole discretion; the most current version will always be posted on this site and will govern current purchases. These terms and conditions may not be supplemented, modified or altered using any other documents(s). Any attempt to alter, supplement, modify or amend these terms and conditions will be null and void unless agreed to in writing by BALANCE BREW PTE LTD.

Account registration

In accessing and utilizing the Service, submitting the Application Form and/or in applying for an account to access or utilize the Service, the User warrants that:

  • The User is at least 18 years of age;

  • The User possesses the legal authority to create a legally binding obligation between itself and BALANCE BREW PTE LTD; 

  • The User will use the Service in accordance with these Terms & Conditions for Users;

All information supplied by the User in the Application Form, on the Website is true, accurate, current and complete during the registration process and the User shall update such information to keep it accurate, current and complete; and the User shall safeguard his account information, including but not limited to its password which it shall not disclose to any third party. The User shall take sole responsibility for any activities or actions under its BALANCE BREW PTE LTD account, whether it has authorized such activities or actions.

Use of products/services

User agrees and represents that it is buying products from BALANCE BREW PTE LTD for their own usage. BALANCE BREW PTE LTD is not responsible nor has liability for any change in configuration. User may decide to mix, repackage, or use in concert with products in order to fit a particular purpose or use. User shall be responsible for any costs associated with changes. BALANCE BREW PTE LTD is not responsible for modifications that do not meet User expectations.

Orders

Orders are not binding on BALANCE BREW PTE LTD unless accepted by BALANCE BREW PTE LTD. Acceptance of an order occurs when product ships. Acknowledgment of receipt of an order does not constitute acceptance of the order by BALANCE BREW PTE LTD. A product ordered may become unavailable due to product or raw material shortages, discontinuance of product, or other reasons. In such event, BALANCE BREW PTE LTD will promptly notify User via email, if provided, or telephone.

Payment terms

Payment methods accepted by BALANCE BREW PTE LTD are shown in the shopping cart on this site.

Payment by Paypal shall be subject to authorization from Paypal and such authorization must be received by BALANCE BREW PTE LTD prior to order acceptance;
Payment by PayNow shall be verified by BALANCE BREW PTE LTD prior to order acceptance, unless some other pre-arranged method of payment has been accepted by BALANCE BREW PTE LTD.

Product prices

Prices and configurations shown on product pages, in the shopping cart, or other locations on the website are subject to change without prior notice at any time before acceptance of User's order. BALANCE BREW PTE LTD is not liable for typographical errors or omissions and mistakes on prices posted on this website.

Shipping and admin charges

Prices shown for all types of products and free gifts do not include shipping and admin/handling charges. User is solely responsible for applicable shipping and admin/handling charges.

Taxes

All products' prices listed in this website include use tax within Singapore.

Title and risk of loss

Title and risk of loss shall pass to User upon shipment from BALANCE BREW PTE LTD's facility.

Limitation of liability

For any breach of these terms and conditions, BALANCE BREW PTE LTD’s maximum liability shall not exceed the total price paid by User for the products ordered by User. In no event shall BALANCE BREW PTE LTD, its suppliers and service providers be liable to User or any third party for any special, indirect, consequential (including damages for loss of business, lost products, or the like), whether based on breach of contract, breach of warranty, tort (including negligence and product liability) or otherwise, even if advised of the possibility of such damages, or for any claim by a third party.

Shipment and availability

BALANCE BREW PTE LTD can only deliver to User addresses in Singapore. BALANCE BREW PTE LTD cannot deliver outside of Singapore. Any delivery or shipment date provided is a good faith estimate. User acknowledges that product availability may be limited, and products may not be available for immediate delivery. BALANCE BREW PTE LTD will not be liable for any loss, damage or expenses related to any delay in shipment or delivery.

Return policies

If User wishes to return a product, User may do so in compliance with BALANCE BREW PTE LTD User service with standard return policies and procedures set forth in these terms of sale. The product must be returned between 3 working days upon receiving the goods from BALANCE BREW PTE LTD and signing off the acceptance of delivery. BALANCE BREW PTE LTD will not accept returns that are of aesthetical damage such as scratches or dents to the exterior surface of the product or the packaging. BALANCE BREW PTE LTD will only accept products that have manufacturing faults, such as unsealed packaging. BALANCE BREW PTE LTD will not bear the charges incurred for shipping or transportation for return of goods.

Assignment of rights

User may not assign their rights or obligations under these terms and conditions without the express written consent of BALANCE BREW PTE LTD.

Severability

If any of these terms and conditions are held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining terms and conditions shall not in any way be affected or impaired thereby.

Entire agreement

These terms of sale constitute the entire and sole agreement between BALANCE BREW PTE LTD and User and supersedes all prior agreements, representations and understandings with respect to the subject matter of these terms.
